Uniform Domain Name Dispute Resolution Policy (UDRP)

At Faster Clouds, we are committed to protecting both the rights of trademark holders and the interests of domain name registrants. This Uniform Domain Name Dispute Resolution Policy (UDRP) outlines the procedures and rules for resolving disputes over domain names registered through our services.

1. Introduction

Faster Clouds adheres to the industry-standard UDRP framework as established by ICANN. This policy is designed to provide a fair, efficient, and cost-effective means for resolving domain name disputes when a registrant’s rights conflict with the trademark or legitimate interests of a third party.

2. Scope

This policy applies to any domain names registered through Faster Clouds that are subject to a dispute regarding alleged infringement of trademark rights or other conflicting rights. It is intended to ensure that disputes are resolved in a manner that is consistent with international standards.

3. Definitions

  • Complainant: The party who files a dispute complaint, claiming that the registration and use of the domain name infringe on their trademark or other rights.
  • Respondent: The current registrant of the disputed domain name.
  • Disputed Domain Name: The domain name at the center of the dispute.
  • UDRP: The Uniform Domain Name Dispute Resolution Policy under which the dispute is resolved.

4. Filing a Complaint

  • Initiation: A complainant seeking to challenge a domain name must file a complaint with an approved dispute resolution service provider (such as WIPO or NAFCIP) following the guidelines and procedures outlined in the ICANN UDRP.
  • Requirements: The complaint must include:
    • A clear statement of the complainant’s trademark or other rights allegedly infringed by the disputed domain name.
    • Evidence supporting the claim.
    • A description of how the disputed domain name has been registered and used in a manner that is inconsistent with the complainant’s rights.

5. Respondent’s Opportunity

Once a complaint is filed, the respondent will be notified and provided an opportunity to:

  • Respond in writing to the allegations.
  • Submit evidence supporting their right to retain the disputed domain name.

6. Panel Review and Decision

  • Independent Review: An impartial panel of experts will review the submissions from both the complainant and the respondent.
  • Decision Criteria: The panel will evaluate the evidence in accordance with the ICANN UDRP rules and determine whether the disputed domain name should be transferred, canceled, or retained.
  • Binding Outcome: The panel’s decision is final and binding on both parties. Faster Clouds will facilitate any necessary changes to the domain registration as directed by the decision.

7. Fees and Costs

  • Complaint Fees: The complainant is responsible for all fees associated with filing and processing a UDRP complaint, unless the panel rules otherwise.
  • Additional Costs: Any additional costs incurred during the dispute resolution process will be allocated as determined by the panel.

8. Renewal and Cancellation Policy

Please note that if a domain renewal is processed, the payment is non-refundable. To avoid being charged for renewal, you must cancel the service prior to the renewal date. Once the renewal is complete, any domain dispute resolution process that results in a transfer or cancellation of the domain name will be handled according to the panel’s decision without any reversal of the renewal payment.

9. Modifications

Faster Clouds reserves the right to update or modify this UDRP process in accordance with changes to ICANN regulations, industry standards, or legal requirements. Any modifications will be effective immediately upon posting on this page.
